Overview

The Senior Legal Counsel is the legal advisor and point of Legal contact for the PBM business unit, which serves self-funded group health plans and an ACA health insurance exchange plan. Senior Legal Counsel will partner with business leaders on contracting, regulatory matters, and other legal needs in a growing, entrepreneurial healthcare business. As such, the Senior Legal Counsel will leverage general health care law experiences and knowledge, as well as specific knowledge of applicable state and federal laws, including state PBM laws, HIPAA, ERISA, the ACA, and the CAA, to support the business leaders with issue evaluation, contracting, proposing solutions, and more.

 

Senior Legal Counsel participates in and provides input on business strategy and legal risks to PBM and partners closely with the rest of the Legal team and Compliance team. Is also backup legal support for other business units, corporate matters, and other duties as assigned.

Remote, home-based within the Continental US.

Responsibilities

  • Provide legal advice and guidance to PBM business Provide backup support other business units, such as the Pharmacy Services unit and rebate aggregator
  • Demonstrate strong business acumen and ability to structure, draft and negotiate contracts
  • Handle fast paced and high-volume workload
  • Identify legal and compliance issues and business risks and offer effective solutions tailored to the situations. Identify and escalate to other leaders and GC as appropriate.
  • Project management of key projects as needed
  • Effectively communicate with all levels across Maxor business entities
  • Demonstrate and apply knowledge of general commercial and healthcare law (such as HIPAA, Anti-Kickback, False Claims Act, state PBM regulations, etc.) plus PBM-related experience and knowledge of laws particularly impacting PBMs to effectively support business unit operations
  • Identify opportunities for process improvements and efficiencies
  • Work under the lead of General Counsel and exercise sound judgment as to matters that require attention of Legal and Compliance Department senior leadership
  • Promote and ensure compliance with Maxor Business Code of Conduct, as well as other company policies and procedures

Qualifications

Education:

  • Juris Doctorate degree from an accredited law school

Experience:

  • 5-10 years’ legal experience with demonstrated excellent working knowledge and primary focus in healthcare
  • Strong preference for candidates with pharmacy benefit management (PBM) client contracting for commercial lines of business and in-house experience
